The terms of this agreement (“Terms”) govern the relationship between you (“you” or “user”) and Miyagawakoki Co.,Ltd. (“Miyagawakoki” or “Us” or “We”) regarding the access and/or use of M-Roof (“App”). Before using this App, please read the following Terms carefully.
By using this App, you are accepting these Terms and you represent and warrant that you have the right, authority, and capacity to enter into these Terms. If you do not agree with all of the provisions of these Terms, please do not use this App.
We shall be able to change these Terms at any time without notifying the user if it deems it necessary.
Section 2 Use of this application
2.1 User shall be able to use this App after agreeing to these terms.
2.2 This app can be used by anyone, but minors shall use it with the consent of a legal representative such as a parent or guardian.
2.3 This App can be used free of charge. It is assumed that the user has agreed to the payment rules of Apple Inc. or Google Inc. depending on the mobile device on which this application is installed, and shall comply with these terms.
Section 3 Handling game data
The user shall not have any property rights, intellectual property rights or any other property rights regarding this App and game data, etc., and shall be able to use it as long as it is permitted by these Terms.
Section 4 Copyright
4.1 The copyright and other rights of this App belong to Miyagawakoki.
4.2 These Terms do not permit the user to transfer the copyright or any other rights of this App, except as explicitly provided.
Section 5 Prohibitions
The user shall not perform any of the following acts, regardless of the user's intention or negligence on this App.If we determine that you violate the prohibition, we will suspend support or take other measures that we deem necessary.
1.Acts that violate on the intellectual property rights (excluding those licensed), portrait rights, privacy rights, honour, credit and other rights or interests of Miyagawakoki, users of this App, or other third parties.
2.Acts that violate public order and morals or laws.
3.The act of disassembling, reverse engineering, etc. to this App and analysing the software.
4.Acts of redistributing or secondary use of this App without permission.
5.Other acts that we deem inappropriate for reasonable reasons.
Section 6 Handling and use of personal information
6.1 We may acquire the information specified below when the user uses this App.
(1) Usage status of this App. (version of this App, usage history, etc.)
(2) Information arbitrarily sent by the user in the process of user registration to this App. (including but not limited to user name and group name)
6.2 Regarding the handling of personal information in this App, in addition to the provisions of these Terms, it shall be based on the application privacy policy of this App.
Section 7 Disclaimer
7.1 We do not guarantee the completeness, usefulness, accuracy, reliability, safety, etc. of the contents of this service. In addition, we do not guarantee that this service can be used under any environment and the data in the user's service will be reflected.
7.2 We do not guarantee that this service is free from defects and errors.
7.3 We may suspend all or part of this service due to regular maintenance without prior notice.
Section 8 Modification or suspension of this Application
In any of the following cases, we shall be able to modify this application or suspend the communication function without notifying the user in advance.
1.When there is a problem with this application
2.When inspecting or maintaining the system related to this application
3.When the system, communication line, etc. stop due to an accident, etc.
4.When this App cannot be operated due to force majeure such as earthquake, snowfall, fire, power outage, natural disaster, etc.
5.When we determine that the App needs to be modified or stopped
Section 9 Changes in contents, termination
9.1 We shall be able to change the contents of this App or discontinue the provision for that reason.
9.2 We shall not be liable for any damage caused to the user due to the actions taken by us, based on the preceding paragraph.
Section 10 Governing law
10.1 The governing law regarding this App and these Terms of Use shall be Japanese law and shall be interpreted in accordance with Japanese law.
10.2 If there is a need for a proceeding between us and the user regarding this service and these Terms of Use, the Nagoya District Court shall be the exclusive court of jurisdiction for the first instance.
